Polish law provides a special procedure for certain social groups for liability for violating professional or ethical duties. It is worth noting that disciplinary liability occurs alongside criminal liability, i.e. often a given disciplinary tort may also be a misdemeanour or a crime, but this does not mean that every disciplinary tort fulfils the elements of a crime or a misdemeanour.
In most disciplinary proceedings, the Criminal Procedure Code is applied as an auxiliary measure. Moreover, the principles of tort liability are modelled on those of criminal liability. Therefore, knowledge of substantive and procedural criminal law is essential when dealing with disciplinary cases. We have the relevant experience in defending disciplinary cases.
